Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and QNSQY (QuaNtum SeQuritY), operated by its founders ("QNSQY", "we", or "us"), the provider of the Software. By downloading, installing, or using QNSQY software ("Software"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Software.

2. License Grant

Free Tier ($0/mo)

The Free tier grants you a non-exclusive, non-transferable, revocable license to use the Software for personal and non-commercial purposes. You may not redistribute, modify, or reverse-engineer the Software. Free tier includes ML-KEM-512 and ML-DSA-44 encryption with a 100 MB file size limit.

Pro Tier ($29/mo)

The Pro tier grants you a non-exclusive, non-transferable license to use the Software for personal and commercial purposes. Your subscription must remain active to access Pro features. Includes all ML-KEM and ML-DSA variants, SLH-DSA, batch operations, audit logging, vault, and rekey with a 25 GB file size limit.

Business Tier ($149/mo)

The Business tier grants you a non-exclusive, non-transferable license to use the Software for commercial and organizational purposes. Your subscription must remain active to access Business features. Includes all algorithms (HQC, FN-DSA, LMS), unlimited file sizes, threshold encryption, steganography, timelock, policy management, escrow, and SIEM export. Business is $149/month ($1,490/year) via self-serve checkout. Volume licensing and custom terms are available under the Enterprise contract, contact [email protected].

Enterprise (contact sales)

The Enterprise contract grants a per-seat license with custom pricing tailored to the deployment (seat count, environment, services). Includes everything in Business plus a signed Service Level Agreement, dedicated engineering channel, quarterly 4-hour readiness consult, white-glove onboarding, and a named customer-success contact. Air-gap license mode and HSM integration are v7.3 roadmap and not shipping today. QNSQY is not FIPS-validated, not SOC 2-certified, not FedRAMP-ATO, and does not sign HIPAA Business Associate Agreements.

3. Payments, Billing, and Refunds

Payment Processor

Paid subscriptions are processed by Razorpay Software Pvt. Ltd., a PCI DSS Level 1 certified payment service provider. QNSQY does not store payment card numbers. Razorpay's privacy policy and terms apply to the card transaction.

Subscription Terms

Pro and Business subscriptions renew automatically on a monthly or annual cycle, depending on the plan you choose. You can cancel at any time by emailing [email protected]; cancellation requests are processed within one business day. Cancellation takes effect at the end of the current billing period.

Refund Policy

Monthly subscriptions are non-refundable once the billing period begins, since the service is delivered immediately upon charge. Annual subscriptions are eligible for a prorated refund within 14 days of purchase if the software has not been used in a production workflow. Refund requests should be sent to [email protected]. Approved refunds are returned to the original payment method via Razorpay within 5 to 10 business days.

Overage and Credit Billing

Pro and Business tiers include a monthly credit allowance. Usage beyond that allowance is billed at USD 0.05 per credit. Overage is charged at the end of each billing cycle. You can set a monthly overage cap in your account dashboard.

4. Restrictions

You may not:

  • Reverse-engineer, decompile, or disassemble the Software
  • Remove or alter any proprietary notices or labels
  • Use the Software for any illegal purpose
  • Redistribute or sublicense the Software without authorization
  • Use the Software to harm others or violate their privacy

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that the Software will be error-free, secure, or meet your specific requirements. Cryptographic software is complex; while we use industry-standard algorithms and best practices, no software can guarantee absolute security.

6. Limitation of Liability

IN NO EVENT SHALL QNSQY, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

Our total liability for any claim arising from your use of the Software shall not exceed the amount you paid for the Software license.

7. Data and Privacy

QNSQY operates on a zero-knowledge architecture. We do not collect, store, or have access to:

  • Your passwords or encryption keys
  • Your files or their contents
  • Your usage patterns or telemetry

If you lose your password, your encrypted files cannot be recovered. This is by design.

8. Updates and Modifications

We may update the Software from time to time. Pro and Business subscriptions include product updates throughout the active subscription period. We reserve the right to modify these Terms at any time; continued use of the Software constitutes acceptance of modified Terms.

9. Export Compliance

The Software contains cryptographic functionality and may be subject to export controls. You are responsible for complying with all applicable export laws and regulations in your jurisdiction. Do not export or re-export the Software to prohibited countries or persons.

10. Termination

We may terminate your license if you violate these Terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession. Sections 5, 6, and 11 survive termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
